PRIVACY POLICY FOR THE “Music Pro” APPLICATION

This Privacy Policy applies to the “Music Pro ” application (the “Application”). The application enables you to up-convert tracks you record on Xperia to Sony Music pro studio quality. You can simulate the sound of Sony vacuum tube mics and Sony Music studio reverb, and remove noise using specially developed audio separation technology.

In this Privacy Policy, we use “SONY,” "we," "us," "our" and “ourselves” to refer to Sony Corporation. “SONY Affiliates” mean Sony Group Corporation, which is the ultimate parent company of Sony Corporation, and any legal entities controlled by Sony Group Corporation. SONY and SONY Affiliates shall be collectively referred to as “SONY Group”. The term “control” in this context means the direct or indirect ownership of at least fifty percent (50%) of the voting interest in such corporation or the power in fact to control the management decisions of such entity.

1.SUMMARY OF KEY POINTS

  • We use the Collected Data (defined below) to provide you with features and functions of the Application, and to provide you with other requested content related to our services and other offerings. We also use the Collected Data to improve and develop SONY Group’s current and future products and services. Please read Section 2 to learn more.
  • This Privacy Policy also describes your data protection rights, including a right to object to some of the processing which SONY carries out. Please read Section 9 to learn more about your rights.
  • We disclose the Collected Data when we engage a third party to process data on our behalf, when such sharing is required by law, or in certain other situations. Please read Section 4 to learn more.
  • Depending on where you are located, the Collected Data may be transferred out of your home country/region to the United States of America, Japan and other jurisdictions that may not provide the same level of data protection as your home country/region. Please read Section 6 to learn more.

2. WHAT INFORMATION DO WE OBTAIN?

We collect and use information or data as described below, some of which may be considered personal information under applicable law in your jurisdiction (collectively, the “Collected Data”), in relation to your use of the Application.

(i) Information about your login data (for user authentication) for the Application

  • E-mail address
  • Your full name
  • Android ID

(ii) Information about your purchase history:

  • Your purchase history regarding the Application purchased through Google Play.

(iii) Information about music performance data:

  • Sound tracks (including vocal) which you upload through the Application.

(iv) Information about your usage history and use status of the Application:

  • Your usage logs (e.g., which Studio tuning options are selected, time stamps)
    • Errors while using Studio tuning;
    • File size of the recorded audio tracks;
    • Information regarding cancellation of the Application service

(v) Information to enable device identification for sending push notices

  • Interface for Amazon Web Service created from device token so that push notices can be sent to your device upon completion of Studio tuning services

3. HOW DOES SONY USE THE COLLECTED DATA?

We use the Collected Data for the following purposes unless the Collected Data is anonymized or de-identified so that it can no longer identify you. We use such anonymized data without restriction.

(i) To operate and provide the features/functions of the Application and related services.

We use the Collected Data in order to operate and provide the features/functions of the Application and related services, such as to:

  • Provide customer service, for example by sending notifications relating to the Application (e.g. new features/updates) and responding to your inquiries/requests;
  • Detect, prevent and manage potential security threats and prohibited activities, and protect or enforce the rights, property, safety or security of ourselves or others;
  • Comply with our legal obligations;
  • verify and confirm payments;
  • process user authentication;

(ii) To optimize the Application and to improve and develop current and future products and services.

We use the Collected Data in order to optimize and improve the Application, for example by analyzing your use of the Application, and to design and develop our products and services.

4. WHO ELSE HAS ACCESS TO THE COLLECTED DATA?

The Collected Data may be made available to SONY Affiliates and to other third parties as follows:

(i) SONY Affiliates

The Collected Data may be shared with and used by other SONY Affiliates to pursue the activities related to the purposes set out in this Privacy Policy.

(ii) Service providers

SONY and SONY Affiliates may use third-party service providers to process the Collected Data on their behalf for the purposes set out in this Privacy Policy. Such third-party service providers include, but are not limited to, IT service providers and data hosting providers.

(iii) Business transfer

In the event that SONY or a SONY Affiliate sells or transfers a portion or all of its business, the Collected Data may be transferred by SONY or such SONY Affiliate to the purchasing or acquiring entity as part of the transaction.

(iv) Compliance with law and protection of SONY and others

SONY may disclose any of the Collected Data if required or permitted by law, regulation or order, or if we believe in good faith that disclosure is reasonably necessary for us to protect or enforce the rights, property, safety or security of ourselves or others, to third parties including government authorities and law enforcement officials, and auditors and similar external consultants like lawyers and tax advisors.

5. DATA RETENTION

SONY will keep the Collected Data as long as it is necessary for the relationship with you or the purposes detailed in Section 3, or necessary to protect ourselves from legal claims, to administer our business, or to the extent permitted by applicable law, which may require us to hold the relevant Collected Data for specific periods. The details of the retention period of each Collected Data are as below:

(i) Account information: For as long as Sony operates the Music Pro service through the Application.

(ii) Transaction history: 10 years and 4 months from relevant purchase.

(iii) Sound tracks: Until you download relevant sound track(s) or until 24 hours after finishing relevant sound track’s Studio tuning.

(iv) Usage logs: For 13 months from recording of usage log.

6. TRANSFER OF THE COLLECTED DATA INTERNATIONALLY

The Collected Data may be transferred in harmony with Section 3 and Section 4 to countries/regions outside your country/region of residence, including in particular Japan and the United States of America, in which the privacy laws may not be as comprehensive as those in your home country/region.

7. SECURITY

SONY Group undertakes reasonable security measures designed to protect against the unauthorized access, loss, misuse or alteration to/of the Collected Data. Although SONY Group strives to protect the Collected Data, SONY Group cannot guarantee or warrant complete security of any Collected Data transmitted to SONY Group through the Application or that SONY Group stores on its systems or that is stored on systems of those third parties contemplated in Section 4.

8. CHILDREN

Sony is committed to complying with all applicable laws and regulations regarding the collection, storage and use of personal information concerning children. The Application is intended for a general audience and does not target users younger than the age of 16. If you are a parent or guardian and are concerned that your child has provided us with personal information without your consent, you should contact us as indicated below.

9. YOUR CHOICES AND RIGHTS

You can request access to, and amendment/deletion of, the Collected Data we hold about you. In some cases, your choices to change or delete information you provide may affect our ability to operate and provide the Application and related services to you. We may decline to process requests which are extremely unreasonable/impractical or not required by law, in particular in order to detect, prevent and manage security threats and prohibited activities, and protect or enforce the rights, property, safety or security of ourselves or others.

10. CALIFORNIA PRIVACY NOTICE

Notice to California Residents

If you reside in California, we are required to provide additional information to you about how we use and disclose your information, and you may have additional rights with regard to how we use your information. We have included this California-specific information below.

CA Personal Information. Consistent with Section 2 above, we may collect certain categories of information about California residents that may be considered “personal information” (“CA Personal Information”) as defined by the California Consumer Privacy Act (“CCPA”) for the purposes described in this Privacy Policy, specifically:

Identifiers: such as email address, account identifiers, usernames and passwords, and device identifiers;

Commercial information; such as purchase and transaction history;

Internet or other electronic network activity information: such as operational status and usage status and usage history of the Application, specifications of content and log information.

Audio, Visual and Similar Electronic Information; such as audio files and other digital content;

Other Consumer Characteristics: such as demographic or profile information.

Sources of CA Personal Information. Consistent with Section 2 above, we may collect CA Personal Information from you or your devices.

Purposes. We collect the CA Personal Information for the business and commercial purposes described above. We also share your CA Personal Information as follows:

  • Sharing your CA Personal Information for Business Purposes: In the preceding twelve months, we may have shared the following categories of CA Personal Information for business purposes: Identifiers and Internet and other electronic network activity information. This information may be shared for the purpose of providing services to you, delivering communications and marketing, for legal compliance, or to protect legitimate interests, in compliance with law.
  • “Sale” of CA Personal Information. In the preceding twelve months, we have not sold (as defined under CCPA) CA Personal Information.

California Consumer Rights. Subject to certain exceptions, as a California resident, you may have the following rights to request: (i) access to your CA Personal Information that we have collected, used or disclosed within the preceding twelve (12) months; and (ii) deletion of your CA Personal Information. To the extent permitted by applicable law, we may retain some of your personal information and certain personal information is strictly necessary in order for us to fulfil the purposes described in this Privacy Policy.

Exercising Your California Consumer Rights. If you are a California resident and wish to exercise any of these rights, you may: (i) submit a request to access or delete your CA Personal Information here: Data Requests; or (ii) contact us by sending an email to privacy@am.sony.com or calling the following toll-free number 1-833-681-9900 with the specific nature of your request, referencing “Your California Privacy Rights – Music Pro”. When submitting your request, you must include your first and last name, mailing address, zip code and email address. To the extent that you elect to designate an authorized agent on your behalf, you must provide your agent with a valid power of attorney or written permission to act for you. Please note that you are limited by law in the number of requests you may submit per year. We will not discriminate against you based solely upon you exercising your rights under CCPA.

When exercising your rights as described above, you may be asked to provide additional proof of identification so that we can verify your identity and validate the request. We are not responsible for requests that are not labeled or sent properly, or do not contain sufficient information to allow us to process your request.

11. CHANGES

SONY may revise this Privacy Policy at any time by posting the new Privacy Policy here.SONY will also notify you of any material changes to this Privacy Policy by prominently posting notice of the amendment on the Application. You are advised to consult the posted Privacy Policy regularly for any changes.
